1. Acceptance of Terms
Welcome to DuckyTrack ("we," "us," "our," or the "Platform"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and DuckyTrack governing your access to and use of the DuckyTrack website, mobile applications, APIs, and all related services (collectively, the "Service").
By creating an account, accessing the Service, scanning a duck tag, making a purchase, or otherwise using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Cookie Policy, and Community Guidelines, which are incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes acceptance of the revised Terms.
2. Eligibility
2.1 Age Requirement
You must be at least thirteen (13) years of age to create an account on DuckyTrack. If you are between thirteen (13) and eighteen (18) years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
2.2 Account Information
When you register for an account, you agree to provide accurate, current, and complete information. You further agree to update your information promptly if it changes. Providing false, misleading, or fraudulent information is grounds for immediate account termination.
2.3 Geographic Availability
The Service is available globally; however, certain features (such as store shipping and payment processing) may be limited to specific regions. You are responsible for compliance with all local laws applicable to your use of the Service.
3. User Accounts & Responsibilities
3.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to or use of your account. DuckyTrack shall not be liable for any loss or damage arising from your failure to protect your account credentials.
3.2 One Account Per Person
Each individual may maintain only one (1) account on the Platform. Creating multiple accounts to circumvent restrictions, manipulate leaderboards, or abuse free tag limits is prohibited and may result in the termination of all associated accounts.
3.3 Account Sharing
Accounts are personal and non-transferable. You may not sell, trade, give away, or otherwise transfer your account to another person. You are solely responsible for all activity that occurs under your account.
3.4 Third-Party Authentication
If you choose to register or sign in using a third-party service (e.g., Google, Facebook), you authorize us to access certain information from that service as described in our Privacy Policy. You remain bound by the third party's own terms and policies.
4. Duck Tracking Service
4.1 How the Service Works
DuckyTrack provides a platform for tracking the journeys of rubber ducks. Users generate or purchase QR-coded tags, attach them to rubber ducks, and release those ducks into the world. When a person finds a tagged duck, they scan the QR code, which directs them to the DuckyTrack website where they can log the duck's location, leave a message, and upload a photo. The duck's owner is notified and can view the duck's travel history on a map.
4.2 Location Data
When scanning a duck, users may be asked to share their geographic location. This is voluntary. If precise GPS location is not provided or permission is denied, we may use IP-based geolocation as a fallback, which provides only approximate city-level accuracy. Publicly displayed location data is always limited to city and country level. See our Privacy Policy for details on how location data is stored and used.
4.3 No Guarantee of Tracking
DuckyTrack does not guarantee that any duck will be found, scanned, or tracked. The tracking functionality depends entirely on third parties voluntarily scanning the QR code. We make no representations about the accuracy, completeness, or reliability of location data or distance calculations.
4.4 Physical Ducks
DuckyTrack is a digital tracking service. We do not own, possess, or control the physical rubber ducks that are tagged and released. You are solely responsible for the rubber ducks you release and for ensuring your activities comply with all applicable local laws and regulations, including those governing littering, placement of items on private property, and disposal of physical goods.
5. User-Generated Content
5.1 Content You Submit
"User Content" includes, without limitation, photographs, messages, guestbook entries, duck names, duck descriptions, profile information, comments, and any other material you submit, upload, or transmit through the Service.
5.2 License Grant
By submitting User Content to DuckyTrack, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform your User Content in connection with operating and promoting the Service. This includes the right to feature your User Content on:
- The DuckyTrack website and any associated subdomains
- Our official social media accounts, including but not limited to Facebook, Instagram, Twitter/X, Reddit, Discord, TikTok, and YouTube
- Promotional materials, newsletters, email communications, and press releases
- Embedded widgets, API integrations, and third-party platforms where DuckyTrack content is syndicated
This license persists for the duration the content remains on the Platform and for a reasonable period thereafter to account for caching, backups, and social media post permanence. You may request removal of your content from the Platform at any time through your account settings or by contacting us; however, we cannot guarantee removal from third-party platforms where the content may have been shared or cached.
5.3 Content Representations
You represent and warrant that: (a) you own or have the necessary rights, licenses, and permissions to submit the User Content; (b) the User Content does not infringe upon, misappropriate, or violate any third party's intellectual property rights, rights of publicity, rights of privacy, or any other proprietary or legal right; and (c) the User Content complies with these Terms and our Community Guidelines.
5.4 Content Moderation
We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion, for any reason, including but not limited to content that we determine violates these Terms, our Community Guidelines, or applicable law. We are not responsible for, and do not endorse, any User Content.
5.5 EXIF Data
For your privacy and safety, we automatically strip EXIF metadata (including GPS coordinates, device information, and timestamps embedded in the image file) from uploaded photographs before they are stored or displayed on the Platform.
6. Intellectual Property
6.1 Platform Ownership
The DuckyTrack platform, including its design, code, graphics, logos, trademarks, service marks, trade names, and all other intellectual property embodied in the Service (collectively, "Platform IP"), is owned by or licensed to DuckyTrack and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform IP except for the limited license to access and use the Service as provided herein.
6.2 User Content Ownership
You retain all ownership rights in the User Content you submit to the Service, subject to the license granted in Section 5.2. DuckyTrack does not claim ownership of your User Content.
6.3 Feedback
If you provide us with feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you agree that we may freely use, disclose, reproduce, license, and otherwise exploit such Feedback without restriction, attribution, or compensation to you.
6.4 Copyright Infringement (DMCA)
If you believe that your copyrighted material has been used on DuckyTrack in a manner that constitutes copyright infringement, please send a notice to [email protected] containing: (a) a description of the copyrighted work; (b) the URL where the infringing material is located; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf. We will respond to valid DMCA notices in accordance with applicable law.
7. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Fraud and manipulation: Submitting fake scan reports, fabricating locations, or using automated tools to generate false tracking data.
- Gaming the system: Artificially inflating your scan count, miles traveled, leaderboard rank, or any other metric through dishonest means, including self-scanning, coordinated manipulation, or bot activity.
- Harassment and abuse: Harassing, threatening, intimidating, or bullying other users through messages, guestbook entries, photos, or any other means.
- Hate speech: Posting or transmitting content that promotes violence, discrimination, or hatred based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
- Inappropriate content: Uploading or transmitting obscene, pornographic, violent, or otherwise objectionable material, including but not limited to content depicting nudity, gore, or illegal activities.
- Spam: Sending unsolicited messages, posting repetitive content, or using the Platform for advertising or promotional purposes without our prior written consent.
- Impersonation: Impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
- Scraping and automation: Using bots, scrapers, crawlers, or other automated means to access, collect, or interact with the Service without our prior written permission.
- Reverse engineering: Decompiling, disassembling, reverse engineering, or attempting to derive the source code of the Service.
- Security violations: Attempting to gain unauthorized access to the Service, other users' accounts, or any computer systems or networks connected to the Service.
- Interference: Interfering with or disrupting the integrity, performance, or availability of the Service or its underlying infrastructure.
- Illegal activity: Using the Service for any purpose that is unlawful or prohibited by these Terms or applicable law.
Violation of this section may result in warnings, temporary suspension, permanent account termination, and/or reporting to law enforcement at our discretion.
8. Duck Store & Purchases
8.1 Products and Pricing
The DuckyTrack Store ("Store") offers physical products including, but not limited to, premium weatherproof tags, rubber ducks, accessories, and branded merchandise. All prices are listed in US dollars (USD) unless otherwise stated and are subject to change without notice. Prices do not include applicable taxes or shipping costs, which will be calculated at checkout.
8.2 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service. DuckyTrack does not store your full credit card number, CVV, or other sensitive payment information on our servers.
8.3 Order Confirmation
When you place an order, you will receive an email confirmation. This confirmation constitutes our acceptance of your order. We reserve the right to cancel any order at any time for any reason, including but not limited to product unavailability, pricing errors, or suspected fraud. If we cancel your order after payment has been collected, we will issue a full refund.
8.4 Shipping
Shipping times and costs vary by destination and shipping method selected. Estimated delivery times are not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather, or other factors outside our control. Risk of loss and title for purchased items pass to you upon delivery to the carrier.
8.5 Returns and Refunds
You may request a return within thirty (30) days of receipt for unused, undamaged items in their original packaging. Custom-printed tags and personalized items are non-refundable unless they are defective. To initiate a return, contact [email protected] with your order number. Refunds will be processed to the original payment method within ten (10) business days of receiving the returned item. Shipping costs are non-refundable unless the return is due to our error.
8.6 Lost or Stolen Ducks
DuckyTrack is not liable for rubber ducks that are lost, stolen, damaged, or destroyed after purchase or release. The purpose of the tracking service is to follow voluntary scans; we do not guarantee the physical safety or recovery of any duck.
9. Premium Accounts
9.1 Subscription Terms
DuckyTrack may offer premium subscription plans ("Premium") that provide access to enhanced features, increased tag generation limits, priority support, and other benefits. The specific features and pricing of each plan will be displayed at the time of purchase.
9.2 Auto-Renewal
Premium subscriptions automatically renew at the end of each billing period (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current subscription price at the time of renewal. We will send you a reminder email before your subscription renews.
9.3 Cancellation
You may cancel your Premium subscription at any time through your account settings or by contacting [email protected]. Upon cancellation, you will retain access to Premium features until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period, except where required by applicable law.
9.4 Price Changes
We may change the pricing of Premium plans at any time. If we increase the price, we will notify you at least thirty (30) days before the change takes effect. If you do not agree to the new price, you may cancel your subscription before the new price applies.
10. Free Printable Tags
10.1 Personal Use
DuckyTrack provides free printable QR tags for personal, non-commercial use. You may print and attach these tags to rubber ducks for the purpose of tracking their journeys on the Platform.
10.2 Rate Limits
Free tag generation is subject to daily and monthly rate limits to prevent abuse. Specific limits are displayed on the Tags page and may vary depending on your account type (free vs. Premium). Attempting to circumvent these limits through automated tools, multiple accounts, or other means is prohibited.
10.3 Commercial Use
Any use of DuckyTrack tags, QR codes, branding, or the Platform for commercial purposes requires a separate commercial license agreement. Commercial use includes, but is not limited to:
- Selling rubber ducks with DuckyTrack tags for profit
- Incorporating DuckyTrack tags or QR codes into products or services offered for sale
- Distributing DuckyTrack tags as part of a paid marketing campaign, promotional event, or sponsored activity
- Using the DuckyTrack name, logo, or branding in connection with any commercial product or service
- Branding tags with third-party logos or corporate identities
- Bulk generation of tags exceeding personal use quantities for resale or commercial distribution
- Integrating DuckyTrack tracking data or APIs into commercial applications

We offer flexible licensing options for businesses, cruise lines, event organizers, tourism boards, and other commercial partners. Our team will work with you to find the right arrangement for your needs.
Unauthorized commercial use of the Platform or its services may result in account termination and legal action.
10.4 Tag Integrity
You agree not to alter, modify, or obscure the DuckyTrack branding on printed tags, or to redirect the QR code to any URL other than the intended DuckyTrack tracking page.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using the Service, you consent to the practices described in the Privacy Policy. We encourage you to read the Privacy Policy carefully.
Additionally, our use of cookies and similar technologies is described in our Cookie Policy.
12. Disclaimers
12.1 "As Is" Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
12.2 No Guarantee of Availability
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
12.3 Tracking Accuracy
We do not guarantee the accuracy of any location data, distance calculations, or other tracking information provided by the Service. Location data is derived from user-submitted GPS coordinates and IP-based geolocation, both of which are inherently imprecise. You should not rely on the Service for any purpose requiring precise geographic measurements.
12.4 Third-Party Content
The Service may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by DuckyTrack. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DUCKYTRACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to, use of, or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any User Content or other content obtained from the Service;
- Unauthorized access, use, or alteration of your transmissions or content;
- Loss, damage, or destruction of any physical rubber duck;
- Any products purchased through the Store.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO DUCKYTRACK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless DuckyTrack and its officers, directors, employees, agents, partners, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Service;
- Your User Content;
- Your violation of these Terms;
- Your violation of any rights of a third party;
- Your violation of any applicable law, rule, or regulation;
- Any claim related to a rubber duck you released, including but not limited to claims of property damage, littering, or personal injury.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") by contacting us at [email protected]. We will endeavor to resolve the Dispute informally within sixty (60) days of receiving your written notice.
15.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. This choice of law applies regardless of your country of residence.
15.3 Jurisdiction
If informal resolution fails, any legal proceedings arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Florida, United States. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue therein.
15.4 Class Action Waiver
To the fullest extent permitted by law, you agree that any Dispute will be resolved on an individual basis. You waive the right to participate in any class action, collective action, or representative proceeding, whether as a named plaintiff, class member, or otherwise.
16. Modification of Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by: (a) posting a notice on the Platform; (b) sending an email to the address associated with your account; or (c) updating the "Last updated" date at the top of this page. Material changes will take effect no earlier than thirty (30) days after notice is provided. Non-material changes will take effect immediately upon posting.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
17. Termination
17.1 Termination by You
You may terminate your account at any time by using the account deletion feature in your Settings or by contacting [email protected]. Upon deletion, your account will enter a thirty (30) day grace period during which you may reactivate it. After the grace period, your personal data will be permanently deleted in accordance with our Privacy Policy.
17.1.1 Released Ducks Are Abandoned
When you delete your account, you abandon every duck you have released. Because a released duck's journey belongs to the community of finders who scan it, abandoned ducks are not deleted — they are re-homed to a DuckyTrack system account ("Adopted Ducks"). On adoption, each released duck is given a new randomly-generated name, its photo and your personal message are removed, and its guestbook (all comments) is cleared, while its QR tag remains valid and its travel history (scans, distance, and map) is preserved so finders can keep tracking it. Tags that were created but never released are deleted. You will no longer own, control, or be associated with any abandoned duck, and abandonment cannot be reversed once the grace period ends. If you wish to keep your ducks, do not delete your account.
17.2 Termination by DuckyTrack
We may suspend or terminate your account, or restrict your access to any part of the Service, at any time, for any reason, with or without notice, including but not limited to: (a) violation of these Terms; (b) violation of our Community Guidelines; (c) fraudulent, abusive, or illegal activity; (d) requests by law enforcement; or (e) extended periods of inactivity.
17.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. The following provisions shall survive termination: Sections 5 (User-Generated Content), 6 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), and any other provisions that by their nature should survive.
17.4 Duck Data After Termination
If your account is terminated, your ducks' tracking history may be anonymized and retained for the benefit of the community. Scan data that has been contributed by other users (e.g., photos and messages from finders) will not be deleted, as those contributions belong to the respective users who submitted them.

19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and DuckyTrack with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, between you and DuckyTrack regarding the Service.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and DuckyTrack's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
